Depending on if Carbine will allow it or not. I presume some form of licensing the game from Carbine then hosting the rest of the costs yourself could work, but I'm not familiar with all that legal mumbo-jumbo. Though they have said that the code will be open for the sake of add-ons, I doubt they'd want everyone having access to every last facet of the game.
It will depend on the popularity of Wildstar
They won't allow free licencing of a product they spend years of time and funds in.
They will probably pop up depending on how well they can emulate things and they will be shut down through legal means.
Since a sandbox has already been created, most likely. It'll fall down to what WS does about it.
There probably will be. However its bound to break the EULA.

Sandbox in a very very rough version, the hard part is all the scripting of events, mobs and so on. Simply getting an empty world up and running makes it still a long time away from actual emulation server.
Honestly i'm not too worried looking at WoW, if you want to play on unofficial servers there they are still far from done and while stable now plenty of bugs and things that aren't implemented not to mention the issues with classes.
And that they do require some sort of donation they keep afloat and thus if you pay you get prior to logins and so forth. I doubt your regular gamer has the patience to deal with these private projects.
Will there be private servers? Probably.
Will the people running them get their asses sued all the way back to last Tuesday? For sure. Just might take some time to get it done.
Some people are way out of reach of any 'suing' If Wildstar is good enough for people to want to invest time and effort into trying to hack the living daylights out of it, I'll be a very happy gamer. It generally means the game is a success, and if it is, most of us will be throwing money at Carbine faster then they can count it
I know that, but getting a Sandbox up is the starting step. AI/Pathing is difficult; however, at least this falls down upon your own skills. Will it be as good as live server? Definitely not, not even close. However, don't doubt peoples' want to not pay a single penny even if it ends up being more difficult and not as good. People do some stupid stuff.
I find it's more about the technical challenge for most administrators of those realms. At least in the beginning.

They were most likely referring to the API for the game's interface.
Personally I've actually never heard of any MMO that had legal private servers.
The Galaxies one is. Also there are some that released their code when they shut down the servers and players have picked it up to keep it going.
Will there be? Probably yes... There are lots of really talented people out there that like to hack and reverse-engineer and stuff. Will they be legal? hell no...
Piracy exists in all forms. Movies, brand clothes, electronics, single player games, everything. MMOs are no exception, just a bit more challenging.
Will there be private servers? Yes, but most likely not until the first expansion comes out.
While I don't imagine NCSOFT has quite the legal budget as Acti/Blizz, I'm sure they'll have enough to go after people if they want to and they're operating in a country that enforces copyright law.
